In Alabama, a person can be charged with a DUI if they are found operating a vehicle with a blood alcohol concentration (BAC) of 0.08% or higher. Even if a driver's BAC is below this limit, they can still be charged with a DUI if they are impaired to the point that they cannot safely operate the vehicle.

The specific penalties for a multiple DUI conviction will depend on how many prior DUI convictions the defendant has on their record.

Second DUI Offense

  • Up to 1 year in jail
  • Minimum 5 days in jail or 30 days of community service
  • Minimum $1,100 in fines
  • Driver's license suspended for 1 year
  • Car impounded for 30 days
  • Ignition interlock device required for 2 years after license is reinstated

Third DUI Offense

  • Between 60 days and 1 year in jail
  • Minimum 60 days of community service
  • Minimum $2,100 in fines
  • Driver's license suspended for 3 years
  • Car impounded for 60 days
  • Ignition interlock device required for 3 years after license is reinstated

Fourth DUI Offense

  • Between 1 and 10 years in prison
  • Minimum 1 year of community service
  • Minimum $4,100 in fines
  • Driver's license suspended for 5 years
  • Car impounded for 90 days
  • Ignition interlock device required for 5 years after license is reinstated
