If you have been the victim of an injury caused by someone else's negligence, we can help. Call (205) 900-7714 today.

We provide representation in Alabama for the following cases:

  • Car accidents: Crashes involving motor vehicles can lead to serious injuries requiring extensive medical treatment. Victims should not be responsible for covering these costs, especially when someone else is to blame for the collision.
  • Truck accidents: Truck accidents are complex as they often involve substantial injuries and several parties may be liable.
  • Motorcycle accidents: Bikers are more likely to sustain serious or catastrophic injuries because they are not protected by a metal structure like passengers in a vehicle. Often, motorcycle collisions result because the driver was inattentive when operating their car.
  • Premises liability: Premises liability law allows those injured on another person's property to file a claim, provided that the cause of the accident was the property owner's negligence in addressing a hazard on the premises.
  • Product liability: Victims can hold manufacturers and distributors responsible for damages resulting from an accident caused by a defective product.

Alabama has a contributory negligence rule stating that if a victim is even partly responsible for an accident, they cannot pursue compensation. Because of this, it is critical that you reach out to a Birmingham injury lawyer to help with your case.

We’ve handled thousands of cases for clients throughout Alabama and have developed many successful resolutions for clients that are suffering the negative effects of another’s actions. Call (205) 900-7714 or contact us online to schedule your free consultation today.

What is the Alabama Personal Injury Statute of Limitations?

If you are involved in an accident in Alabama that results in serious bodily injury, it’s important that you file your lawsuit as quickly as possible to ensure that you are able to pursue compensation for your injuries. The “statute of limitations” refers to the laws that limit how long after an incident a victim may take legal action against the other party. Each state has its own statute of limitations governing personal injury claims, for Alabama, it’s two years. If you do not file a claim within two years of your injury, you may lose the right to pursue compensation at all.

There are a few instances where the normal statute of limitations may not apply. For example, under Alabama’s statute of limitations discovery rule, if you suffered an injury that you were unable to detect for a certain period of time, you may be allowed to extend the statute of limitations to the date when you discovered (or reasonably should have discovered) your injuries. For situations like this it’s important to have a lawyer who can argue your case and prove your right to bring an injury lawsuit against the individual responsible.

For situations where only property damage was sustained, victims still have the right to pursue compensation for up to two years after the date of the accident, with the exception of property damage that was caused as a result of trespassing. This is known as Alabama’s statute of limitations on property damage.

Negligence In Alabama

It is important to know that Alabama is one of the few states that operates under the "contributory negligence" rule, which relates to "shared fault" in an accident. The rule states that if the plaintiff was at fault for the accident that took place—even to a small extent—then he or she cannot receive compensation for injuries. In a trial, the jury would determine whether or not the injured party held a percentage of fault for the accident occurring.

This law makes it even more crucial that you hire a skilled personal injury lawyer who can prove to the jury that the fault lies solely with the negligent party. In other situations, you might benefit more from making a settlement agreement with an insurance adjuster instead of going to trial. Either way, hiring an experienced lawyer is your best bet for being able to recover the compensation you need and deserve.
